Acknowledgment and disclaimer form

Based on the Authority's keenness to organize, support and sponsor the small and medium enterprises sector in the Kingdom in accordance with best practices, to raise the productivity of these enterprises, increase their contribution to the gross domestic product, and increase the absorptive capacity of the Saudi economy, which leads to job creation for the national workforce. The Franchise Center provides a set of educational materials and information that enables franchisors to present investment opportunities in the franchise system and facilitate the access of potential franchisees to those opportunities. Accordingly, this form was prepared for the declaration and commitment of the platform beneficiary to the following:

1.            Acknowledge that the "Franchise Center" and/or the "Franchise Center Platform" is a non-profit entity that aims to enable franchisors to offer investment opportunities in the franchise industry and facilitate potential franchisees to access those opportunities.

2.            Acknowledge that the data, information, and materials published on the platform are available for public use, it is not permissible to publish any information or opinion expressed through the "platform" without obtaining a prior written consent from the "Franchise center".

3.            Acknowledge that information about the brands’ Franchise opportunities published on the platform is subject to continuous modification, as needed.

4.            Acknowledge that the promoted franchise opportunities are subject to change due to variability in supply and demand as well as, the plans and abilities of the franchisor to expand.

5.            Acknowledge that the “platform” and / or “the Center” are not a party to any agreements or contracts and do not guarantee the obligations of any of the contracting parties in any way, nor guarantee the implementation of each party’s obligations and/or adherence to the franchise agreement. Thus, The Center and/or the Platform bears no responsibility as a result. Without prejudice to the generality of the foregoing, the Center and / or the Platform shall not be responsible for any disputes that occur between the two parties of the franchise agreement, including cases of allegations of fraud, misrepresentation, or false description, as well as refunding franchise fees, or claiming a lack of investment data, or otherwise such as claims, regardless of their cause, and on legal or factual basis wherein they are based.

6.            The Beneficiary acknowledges bearing responsibility of consulting an attorney and advisors regarding legal, financial as well as any other aspects related to investment in the franchise opportunity and its probability of success with no responsibility befalling the “center” and/or “platform”.

7.            Acknowledge that the “center” and / or “platform” are not responsible, in whole or in part, for any current or potential direct or indirect, accidental, consequential or punitive damage, whether private or public, nor are they responsible for any opportunity loss, loss or damage of any kind, including but not limited to, any damage or harmful software that may be exposed to the personal computer as a result of accessing this page, and that the “platform” and its representative makes every effort to ensure that the information available through the service As comprehensive and accurate as possible.

8.            Acknowledge that the links provided by the platform to other portals and/or websites related to franchisors aim to facilitate the potential franchisee’s access to the franchisor’s brand information are not endorsed by the “platform” nor contents of the portals and/or websites to which the “platform” is linked, all consequences of using these links are the responsibility of the user without any responsibility befalling the “platform”. The “platform” does not guarantee that these links will work permanently, nor does the “platform” have the authority to replace these links.

9.            Acknowledge that your approval of the acknowledgment form means your agreement to the terms and conditions to which the franchise platform is subject to (https://franchisecenter.sa/)and the continuous modifications that are made on the platform as needed.

10.          The beneficiary shall abide by the laws and regulations of the Kingdom and shall not violate the traditions and culture of the community and shall be held fully responsible in the event of violating this commitment.

11.          In the event of breaching any of the acknowledgments and disclaimers the Center has the right to take whatever action it deems appropriate.
